Know your rights

You are guaranteed rights under the United States Constitution, no matter your immigration status. Visit the ACLU Immigrations’ Rights Website to learn more about different scenarios. Some of the most common are…

What to do in case of an ICE encounter?

  • DO remain calm

  • DO remember: You have the right to remain silent.

    • Do not lie about your status or provide false information. It is best to stay silent

    • You have the right to say, “I do not wish to speak with you or answer your questions.”

  • Do report the encounter to ICIRR’s Family Support Hotline (855) 435 - 7693

What if ICE knocks on my door?

  • Stay calm, keep the door closed.

  • You are NOT required to OPEN THE DOOR TO YOUR HOME without a warrant signed by a judge.

  • Ask if they have a warrant signed by a judge and to show it at the window. It must be signed by a “U.S. Magistrate Judge.” If all the information is correct, everyone must remain silent.

  • You are NOT required to sign any document.

If you suspect you might be arrested by ICE:

  • You have the right to ask “Am I under arrest?” and “Am I free to go?”

  • Ask if you can freely leave. If the officer says yes, do so calmly.

  • You can tell them you want to remain silent and want to speak to a lawyer.

Remember that after the incident you should write down everything you remember! Include descriptions of the agents, such as names, badges, and license plates. Take pictures of any injuries.

Call the FSN number: (855) 435- 7693 and report what you experience. Use the same phone number if you are a witness to the event.
